Terms of Use

The agreement
These terms govern your use of Migrate Tenant, operated by BITSUMMIT. By creating an account or running an engagement you agree to them. If you are using the service on behalf of an organization, you confirm you have authority to bind it.
Your tenants, your authority
The service acts only on Microsoft 365 tenants for which you grant consent through Microsoft's admin consent flow. You are responsible for having the authority to migrate the data in those tenants, for the accuracy of your mappings, and for choosing when to cut over. We provide verification tooling; final sign-off on a migration is yours.
Acceptable use
Use the service only to migrate data you are entitled to migrate. Do not attempt to access other customers' engagements, probe the service for vulnerabilities outside a coordinated disclosure, resell access without a partner agreement, or use the service in violation of Microsoft's terms for the underlying APIs.
Fees
Pilot engagements are free within their published limits. Paid engagements are billed per migrated seat at the rate shown at purchase. Fees are due when the engagement's migration phase begins and are non-refundable once seats have been migrated and verified, except where the service failed to perform.
Service and support
We operate the service with commercially reasonable skill and care, schedule maintenance to avoid cutover windows you have booked, and support paid engagements through cutover. The service depends on Microsoft 365 APIs; conduct or limits imposed by Microsoft (such as throttling) are outside our control, though the service is built to work within them.
Liability
To the maximum extent permitted by law, our aggregate liability arising out of an engagement is limited to the fees paid for that engagement, and neither party is liable for indirect or consequential loss. Nothing in these terms excludes liability that cannot be excluded by law.
Changes and termination
We may update these terms; material changes will be posted here with a new date, and continued use after that constitutes acceptance. You may close your account at any time; we may suspend accounts that breach these terms. Questions go to hello@migratetenant.com.
